An appeal is a procedural document drawn up by the accused, the victim, the civil plaintiff, the defendant (their representatives), or other persons in order to protect their violated rights and cancellation of an unlawful court decision that has not entered into legal force. Only decisions of the magistrates' court are subject to appeal.

Step 1

Russian legislation does not regulate the procedure for writing an appeal. It is only mentioned that persons (accused, victim, civil plaintiff, etc.), whose rights are violated by a court verdict, can appeal against them. To do this, you must file a complaint in writing with the court that delivered the verdict in the case.

Step 2

You must start writing a complaint by filling in the so-called "header". It indicates the name of the court to which the complaint is filed, surname, first name, patronymic, the procedural position of the person filing the complaint, his address, contact phone number. It is also necessary to indicate the data of other participants in the case who are interested in the outcome of the case.

Step 3

Then write "appeal" in the center of the line. Then, in a free form, you set out the very essence of the appeal. Here it is necessary to briefly indicate the essence of the case and the decision taken on it, as well as what violations were committed (if possible, make references to the articles of the law), by whom they were committed. If there is new evidence that can influence the decision, please indicate it, and, if possible, attach it to the complaint. You can indicate your way out of this situation and the way to restore your rights.

Step 4

Then indicate the request to remedy the violation of your rights. In this case, it is necessary to indicate your desire to cancel the previously issued sentence, or to amend it. Then sign your complaint, put the current date. The complaint is signed by the person (his representative) who drew it up. The finished complaint (with copies according to the number of persons participating in the case) must be handed over to the court registry.
