In some life situations, it is impossible to avoid a collision with bailiffs. Failure to enforce the judgment leads to the confiscation of property. But this unpleasant measure can be avoided.
Instructions
Step 1
If it is not possible to execute the court decision in a timely manner, enforcement proceedings begin in the UFSSP. In the course of enforcement proceedings, be sure to receive information in a timely manner. Consult with a lawyer and find out possible options for the development of the process. Submit the documents requested by the bailiff on time. Do not argue or quarrel with him under any circumstances - this may adversely affect the course of the proceedings.
Step 2
Get a postponement of the execution of the decision, apply to the court. Remember that if there are grounds that the financial situation is rather difficult and the execution of the court is impossible at the moment, the court has the right to give payment by installments. But you will have to pay exactly according to the schedule, since otherwise the installment plan will lose its force.
Step 3
Be aware that the property that takes part in production activities cannot be seized, as this will entail a shutdown of activities in general. There is a way out - pay collection on debit debt.
Step 4
Transfer property for rent, use or storage to third parties; sell or arrange for a write-off on any other basis. Submit to the bailiffs all the necessary documents proving this, since remember that only property belonging to the debtor and nothing else can be confiscated. It is for this reason that you decide the property issue even before the start of the court proceedings.
Step 5
Radical ways to avoid confiscation are either bankruptcy or reorganization, since when a bankruptcy case is being considered, enforcement proceedings in another case are stopped, and the arrests are lifted and confiscation, accordingly, cannot be carried out.
