By purchasing a discounted product or a used product, the buyer does not lose the opportunity to protect his rights provided for by law. However, you should know and take into account the peculiarities of commission trading.
In addition to the Law "On Protection of Consumer Rights", retail purchase and sale of goods in consignment shops is regulated by special rules, for example, the Rules of Commission Trade in Non-food Products (Government Decree No. 569 of 06.06.1998), Rules for the Sale of Certain Types of Goods (RF Government Decree No. 55 dated 01.19.1998).
Commission trading assumes that a citizen (either a foreigner or a stateless person) transfers the goods to the seller, who sells it under a sales contract, receiving a fee for this. Both new and used goods can be transferred to the commission.
The goods belong to the citizen who handed over it until the moment of sale, and the seller is responsible for the safety of this goods for the entire period of time that the goods are on commission.
Cars, motorcycles and other vehicles must be deregistered prior to their sale, have a temporary "transit" sign, customs passports, if necessary, and can only be handed over for sale by the owners.
Prohibited or restricted for sale goods, as well as goods that cannot be returned or exchanged for similar ones: personal hygiene items, household chemicals, medicines, etc., cannot be commissioned.
Goods sold through a commission store must have a product label or price tag with a link to the document on the basis of which the goods were accepted for commission. In addition, the product label contains information about the product: new or used, degree of wear, defects, etc.
The product label on the car must also contain the identification number, make, model, year of manufacture, engine number, color, mileage.
If the warranty period has not yet expired for the goods transferred to the commission, the warranty card and service book are also transferred to the seller. The goods must go on sale the next day from the date of their transfer to the commission seller.
If, after the purchase, defects in the goods are discovered, which the seller of the commission store was silent about, the buyer has the right to demand a replacement, free repair of the goods, a reduction in price or a refund.
