Step 1
If you have not received a salary for a long time, and your own financial resources have long run out, try to talk to your boss and resolve this problem. If there are no results, file a complaint with the regional office of the State Labor Inspectorate, it is this municipal body that monitors employers' compliance with labor legislation.
Step 2
The State Inspectorate will appoint an inspection of the enterprise, during which the employer will have to eliminate all violations and pay you wages, in accordance with Articles 353-357 of the Labor Code of the Russian Federation. The supervisory authority has the right to bring your employer to administrative and, in some cases, criminal liability.
Step 3
You also have every right to write a statement to the prosecutor's office, which will definitely check the fact of non-compliance by the employer with labor laws. It is advisable to contact the prosecutor's office of the region where the entrepreneur carries out his direct activities. The prosecutor has every right to go to court on your behalf, demanding the collection of wages from the employer in your favor.
Step 4
You can collect your salary from your employer by contacting a labor dispute resolution committee. A similar body usually exists in large enterprises. If it is not there, you have a direct road to the district or city court. In the event that you go to court with a demand to pay your salary, you have the right not to pay the state fee.
Step 5
If the employer did not pay you a salary for two months, or paid it only partially for three months, or the size of the salary given to you for two months was less than the minimum wage, you have the right to apply to the Investigative Committee of the Russian Federation with a corresponding statement. According to articles 141, 144, 145 and 151 of the Criminal Procedure Code of the Russian Federation, a criminal case will be initiated against your employer, and you have every chance of winning.
