Persons connected by family relations are obliged to take care of each other and provide material support to a loved one in need. Assistance can be provided voluntarily or based on a court decision. The law establishes the procedure, size and term for the payment of the required financial allowance.

Step 1
At the legislative level of the Russian Federation, the obligation is fixed - to pay alimony to close relatives. According to the Family Code of the Russian Federation, close relatives include: children, parents, brothers and sisters, grandmothers, grandfathers, grandchildren, as well as adopted children and parents. The amount of alimony can be determined by the parties independently or set at the discretion of the court. If alimony is paid by agreement of the parties, then this agreement can be secured by signing a written agreement on the payment of alimony. If a person evades the fulfillment of his duties in relation to his disabled relative, the court may oblige to provide assistance and support.
Step 2
The payment of alimony for the maintenance of their minor children is carried out until the age of majority. An exception is the situation when the child is an adult, but unable to work. In this situation, the court can analyze the circumstances of the case and assign the payment of alimony on a monthly basis, but in a fixed amount. A spouse caring for a joint child can also count on receiving alimony. Alimony is paid to the spouse until the child reaches the age of three. The payment may be levied regardless of whether the spouses are living together or apart. The payment of alimony to underage brothers and sisters by adult brothers and sisters is carried out until the minors reach the age of eighteen years. As well as in a situation where grandparents pay alimony to their minor grandchildren until the latter reaches the age of majority.
Step 3
There are alimony obligations that are not limited to certain ages, but are paid until the time the alimony recipient needs financial support. Such persons include: disabled adult children with disabilities, disabled parents, disabled spouses and former spouses, as well as disabled persons who were the actual caregivers (stepfather and stepmother). To order the payment of alimony, you must apply to the court at the place of residence of the person who, by law, is obliged to provide financial support. If the place of residence of the person is unknown, then you can apply to the court at the place of residence of the person entitled to receive alimony. The statement of claim shall be accompanied by documents confirming the relationship of the parties, incapacity for work, and available monetary income.
