You can get alimony from a husband who is hiding by going to court with subsequent control over the execution of the court decision, assistance to bailiffs. In addition, you should use alternative sources of influence on the defaulter of alimony.
Instructions
Step 1
Go to court with a claim for the recovery of alimony in the amount determined by family law. After the court's decision is made, you should wait for it to come into legal force (one month from the date of the full text of the judicial act in the absence of an appeal).
Step 2
Get a writ of execution in the court that made the decision to recover the alimony. This document is issued immediately after the entry into force of the judicial act in the office of the court. It is he who is the basis for initiating enforcement proceedings and enforced collection of debts from her husband.
Step 3
Submit the writ of execution to the territorial subdivision of the bailiff service, attaching it to the application for initiation of enforcement proceedings. After the initiation of proceedings, find out from the office of the bailiff service department the specific official who is engaged in the enforcement of the judicial act, make an appointment with him.
Step 4
Go to an appointment with a bailiff, ask about the course of enforcement proceedings in a particular case. Provide the bailiff with additional information about the hiding husband, including his possible place of work, addresses of residence or stay, coordinates of relatives and friends.
Step 5
Periodically monitor the process of execution of the court decision by calling the bailiff, inquire about the actions that the authorized official takes in order to find the debtor. Submit a petition for an interim measure in the form of a ban on your husband from leaving the territory of the Russian Federation.
Step 6
If there is information about the property belonging to the husband, you should also inform the bailiff of this information (addresses of real estate, registration numbers of vehicles). If the specified property is found, then send the bailiff a petition to take an interim measure in the form of the arrest of the debtor's property until the husband pays off the alimony debt in full.
Step 7
Use alternative methods of collecting alimony from the debtor. In particular, if there is information about the locality in which he lives, advertisements in newspapers should be published, other options for publicity should be used. If his place of work is known, then the information about the husband's arrears in the payment of alimony should be reported to his management and colleagues. Often such measures turn out to be more effective than the work of a bailiff, since alimony debtors fear publicity.
