Unfortunately, the situation when the ex-husband avoids paying child support is quite common. A man can do this out of a sense of revenge on his ex-wife, because of the lack of a permanent job and for a number of other reasons that do not justify such an attitude towards his own children.
Try to negotiate peacefully with your ex-husband. Calmly explain to him that your salary is not enough to support your common child, that his help, as a father, is extremely necessary.
If your ex-husband does not respond to your arguments, contact the police. In the Criminal Code of the Russian Federation there is an article №157, which is called "Evasion of the payment of alimony." You need to write a statement to bring your ex-spouse to court. The maximum sentence under this article is three months in prison. It is also possible to involve a male dodger in correctional labor.
Even if your ex-spouse does not work anywhere, he is still obliged to pay regular maintenance for the child. Where he can get money for this is his problem. As a last resort, bailiffs can describe and seize the property of a negligent father.
If the ex-husband is receiving a disability pension and is disabled, this does not exempt him from paying monthly child support payments. Criminal Article 157 applies to all categories of citizens without exception.
The maximum amount of alimony is 70% of salary.
If a man works, but is considered unemployed, contact the local police station. The bailiff will be obliged to identify the actual financial situation of the debtor, as well as to find out whether he is working or not.
Even if the ex-husband was deprived of parental rights, he is still obliged to pay alimony. If the child is already 18 years old, the amount of the debt on payments is also not forgiven, until it is repaid by the defaulter.
Today in Moscow there are about 15,000 alimony workers, who are hunted by bailiffs. The average debt is 20,000 rubles. If the amount of alimony has not been paid for the entire period, then it will be collected throughout life.
