Who is eligible for early retirement

The main condition under which an unemployed person has the right to apply for early registration of a pension is his dismissal from his previous job for one of two reasons clearly spelled out in the legislation: a reduction in the number of personnel or the liquidation of an enterprise. Other grounds, including valid ones, for example, dismissal for medical reasons, do not give such a right.

Age is determined by subtracting the baseline, 2 years, from the estimated retirement age. If it is 60 and 55 years for men and women, respectively, only the unemployed who have reached the age of 58 and 53 are eligible for early retirement. However, the Labor Code provides for a number of preferential grounds for lowering this age bracket due to the special conditions of work in some professions, for example, a bus driver or a teacher. Work experience must be at least 25 and 20 years, respectively.

Only official unemployed registered at the local employment center can exercise the right to early retirement, and they should not have offenses for which the calculation of social benefits is temporarily suspended, or two refusals to find a job suitable for them.

How is the registration

A person dismissed due to staff redundancy or in connection with the liquidation of an organization must immediately register with the employment authorities at their place of residence, having in hand a passport, work book and a certificate of wages. For some time he will be offered a job, but if his specialty is rare and highly qualified, the employees of the labor exchange will experience difficulties in selecting places of service for him, and it is unprofitable to send people of pre-retirement age for retraining. In this regard, they will issue him an application with a proposal for early retirement, with which the unemployed must go to the pension system. If the result of consideration of the application is positive, it is removed from the register at the employment center and begins to receive a pension. The only caveat is that until the real term is reached, when he would become a pensioner, a person does not have the right to get a job, otherwise he will lose his pension.

Since the payments made by the Pension Fund will be compensated by the employment agencies from budgetary funds, the latter, due to exceeding the quota, may refuse to issue a referral. A person who has faced a refusal and considers it unreasonable can apply to the court or the regional Ministry of Labor and Employment.
