Any appeal to the court must be formalized as a statement of claim or complaint. In most cases, the immediate outcome of the case depends on their correct execution - that is why you need to write to the court competently and in compliance with all the requirements of the law.

Step 1
If you want to achieve what you want and prove your own innocence in court, before writing a statement of claim, prepare documents on the basis of which the court can initiate legal proceedings. Have you suffered significant damage or been denied something in violation of your legal rights? For example, if they do not want to return money to you for a cell phone that you returned intact in accordance with the law within 14 days, attach a written refusal from the store management to the statement of claim. The more evidence you have on hand, the more likely you are to win the case.
Step 2
The statement of claim, in accordance with the norms of Russian law, is drawn up in writing and in two copies (one remains in court, the second will be given back to you with a note on the date of its acceptance for consideration). Use a regular A4 paper sheet to draw up your claim. In the upper right corner, indicate the exact name of the court to which you want to apply with the application. Then - your name, information about the place of residence and registration.
If a representative will take part in the consideration of the claim instead of you, you must also indicate his name and contact information. Further, you can write in free form the essence of the complaint or claim with which you decided to go to court. List the reasons and circumstances that prompted you to do this. If your claim is for financial gain, do not forget to indicate the cost of the claim. At the end of the document, list a list of the evidence attached.
Step 3
In order for the court to accept your claim for consideration, you will have to pay a state fee. It is directly dependent on the price of the claim. Such a fee is paid to a state bank, the receipt is attached to the statement of claim.
