Has production technology changed in your organization? Are you unhappy with the fact that employees spend a lot of time on smoke breaks and get-togethers, and you want people to have a material incentive in the final results of their work? Having decided to transfer workers to piecework wages, proceed as follows.
Instructions
Step 1
Make a written notice to the employee about the upcoming changes in working conditions (at least 2 months in advance about the transfer of the employee to the deal). Reflect in the notification the objective reasons for the changes in working conditions, and what kind of changes in working conditions are coming (in your case, the introduction of a new remuneration system). Indicate in the notification from what date the new remuneration system will be introduced.
Indicate in the notice that if the employee does not agree with the upcoming changes, then the employment contract with him may be terminated. The worker must express in writing his consent or disagreement with the upcoming changes. Let him write in the notice: “I agree with changes in working conditions”, or “I do not agree with changes in working conditions”, put down the number and his signature.
Step 2
Issue an order for the enterprise to cancel the old and introduce a new system of remuneration. In the order, you must reflect in connection with what changes the new remuneration system is being introduced, approve the developed changes to the Regulation on remuneration regarding piece rates. Make an annex to the order (an extract from the amendments to the Regulations on Remuneration, where the piece rates for the work performed will be prescribed). Familiarize the employee with the order and the appendix to it, who is being transferred to the transaction. The worker must know how and for what he will receive wages.
Step 3
Prepare an additional agreement to the employee's employment contract, which will spell out a new remuneration system (if the employee agrees with the transfer to the transaction). The additional agreement must be dated by the date from which the piece-rate wages are introduced. After 2 months from the day the employee is notified, sign the agreement by the employee and give him a second copy of the document. From that date on, his work will be paid according to the approved piece rates.
Step 4
Draw up and send the employee a written offer of a new job if he refused to work under the new pay system. Offer the employee available vacancies at the enterprise, taking into account his qualifications and health status. The employee must express his consent or disagreement to the translation in writing. If the employee refused to transfer to another position, you have the right to dismiss him after 2 months from the date of familiarization with the notification of the introduction of piecework wages under paragraph 7 of Art. 71 (in connection with the refusal of the employee to continue working in connection with a change in the working conditions determined by the parties). Upon termination of employment, pay the employee compensation equal to two weeks' average earnings.
