Late payment of wages is contrary to labor legislation and leads to untimely repayment of regular loan payments that many Russians have.
It is necessary
- - certificate of non-payment of wages;
- - application to the bank;
- - application to the court.
Instructions
Step 1
If you are not paid wages, and you cannot make the next payment on the loan, contact your employer, get a certificate confirming the delay.
Step 2
Next, contact the bank with a statement in which you ask to defer payments. Attach the certificate you received. The lending institution may give you a certain amount of time during which you will need to pay the minimum amount to repay the interest rate on the loan. But such an outcome of events is possible only in the best case. Banks are very reluctant to grant deferred payments and do this only as an exception for bona fide customers who have previously regularly repaid the entire amount of monthly payments.
Step 3
At the same time, it is unprofitable for the bank to go to the conflict and collect the debt by force. Moreover, the courts of the Russian Federation almost always take the client's side. Forced debt collection entails an inventory of property if the client has no income due to non-payment of wages and there are no bank accounts. And the property must be sold before the debts are paid off. Therefore, it is always more profitable for the bank to conduct a constructive dialogue and still receive the borrowed funds issued to the client in full.
Step 4
Undoubtedly, if you have solvent guarantors, you will not be able to get a deferred payment. The guarantors bear proportionate responsibility for loan payments on an equal basis with the client, and in case of late repayment of regular payments, they are obliged to pay the entire amount in full.
Step 5
If the bank has refused to provide you with a restructuring, contact an anti-collection agency or a lawyer specializing in credit matters. This is especially effective if the bank has transferred the debt collection case to a collection agency, which in many cases is illegal.
Step 6
From an employer who does not pay wages on time, you can recover the entire amount in court, demand a forfeit and enforce all the amounts of fines accrued by the bank.
