The decree on eviction from the communal apartment, which is in force today, was issued by the Plenum of the Supreme Court of the Russian Federation on July 2, 2009. This decree explains some of the applications of the Housing Code. In particular, the procedure for eviction from municipal housing.
Instructions
Step 1
The case of eviction of persons living in communal municipal housing at the request of the landlord is being considered. This lawsuit is filed by the landlord for the eviction of the tenant and the members of his family living with him, for the termination of the social lease agreement. At the same time, the tenant is provided with the provision of another residential premises, in accordance with the social rental agreement.
Step 2
File a claim with the district court if the tenant - the person who lived in the apartment - fails to pay rent and / or utility bills without good reason within six months.
Step 3
Provide the court with documents supporting the basis of your claim. When considering such a claim for eviction, the court will have to consider and establish for what reasons the tenant was unable or did not pay for the services provided to him - rent of premises and (or) utilities.
Step 4
You will also need to establish how long the obligations under the social housing lease agreement were not fulfilled - no rent or utilities were paid. The reasons for not paying for housing are established for all family members of the tenant - capable or limited by the court in legal capacity, due to health problems or for some other reason.
Step 5
Please note that there are a number of good reasons why an employer or family members may temporarily not pay rent or utility bills. Such circumstances include, for example, long delays in the payment of wages or retirement benefits.
Step 6
Also, valid reasons include the difficult financial situation of the employer or his family members. Such a difficult financial situation may be associated with the loss of jobs and the impossibility (inability) of employment, despite the measures taken. It can also be the poor health or illness of the employer or his family members. It can also be the presence in the family of people with disabilities, imperfect children and other persons who do not have employment opportunities.
