The sale of alcohol and tobacco products to minors in our country is prohibited by law. However, some buyers who have every right to make such a purchase look quite young. How can they prove their age?
The procedure for the sale of alcohol in our country is regulated by law. In particular, the rules for its implementation and the main categories of citizens who do not have the right to purchase it are listed in Federal Law No. 171-FZ of November 22, 1995 "On state regulation of the production and circulation of ethyl alcohol, alcoholic and alcohol-containing products and on restricting consumption (drinking) alcoholic beverages ".
Alcohol sales rules
The main requirements for the procedure for the retail sale of alcohol are fixed in Article 16 of the specified regulatory legal act. At the same time, paragraph 2 of this law establishes that the sale of alcoholic beverages to minors is prohibited. At what age is this ban lifted?
The age limits for the onset of majority are established, in turn, by part 1 of the Civil Code of the Russian Federation, registered in the code of laws of our country under number 51-FZ of November 30, 1994. Clause 1 of Article 21 of the regulatory legal act in question fixes that the full legal capacity of a citizen, which is also called the age of majority, in our country begins from the age of 18.
Documents confirming the age of the buyer
In what ways can a buyer who has reached the required age and has a desire to purchase alcohol can prove his majority if the seller has doubts about this? After all, the latter has the legal right to make sure that the buyer really has a reason to purchase alcoholic beverages. The answer to this question is contained in the Order of the Ministry of Industry and Trade of the Russian Federation No. 524 of April 15, 2011 "On approval of the List of identity documents and allowing to establish the age of the buyer of alcoholic beverages, which the seller has the right to demand if he doubts that this buyer reaches the age of majority. ".
Among the documents that with a high degree of probability a Russian citizen may have with him are civil and foreign passports, as well as a temporary identity card, a serviceman's identity card or a military ID. In addition, you can prove your adulthood by presenting a seaman's passport, diplomatic or service passport. Finally, the order contains a list of documents that foreign citizens can present in such cases.
It should be noted that, contrary to popular belief, a driver's license by law cannot act as a document confirming the age of the buyer when purchasing alcohol. Therefore, the seller's refusal to accept it for consideration is entirely justified.
