Recently, the issues of application and implementation of the rules for registering citizens have acquired particular importance. The main reason for this was a significant increase in the number of offenses committed by persons who live in the territory of the Russian Federation without documents and registration.
The Constitution of the Russian Federation guarantees every citizen the right to free movement throughout its territory, as well as the choice of a place of stay and residence within its boundaries. In order to implement this provision, normative acts were adopted that regulate legal relations in this area. Instead of registration, the registration of citizens at their place of residence was introduced. Its main difference is that it is not permissive, but of a notification nature. Registration at the place of residence should be understood as a special registration of citizens carried out by authorized state bodies in order to obtain data on population migration. Registration is a kind of permission for a citizen to reside in a particular locality. Registration is an obligation, not a right. This should not be regarded as an infringement of the human right to free movement, since the choice of place of residence is made independently. For registration at the place of residence, a citizen must submit an application to the registration authority, presenting a passport or other identity document, as well as documents confirming the right to move into the dwelling. Violation of the rules of registration of citizens entails the onset of administrative responsibility. Registration at the place of residence is associated with many legal aspects: these are the issues of calculating and paying pensions and benefits, determining the procedure and types of benefits provided (in different regions they differ from each other), related issues with tax registration, queuing for housing, exercising voting rights, receiving medical assistance, etc. Thus, we can conclude about the great importance of registration in the life of any person, without which the normal exercise of the rights provided for by law is impossible.
