The punishment for leaving the scene of an accident depends on the degree of guilt of the driver; however, if certain conditions are met, administrative liability may not arise.
The number of cars on the road only increases every year. At the same time, the percentage of inexperienced drivers also increases, and almost in arithmetic progression. Lack of experience, insufficient level of training often leads to big troubles, not only in the form of fines for traffic violations; It is not uncommon for an inexperienced driver to get into a traffic accident.
According to statistics, most accidents are classified as mild, i.e. minimal damage is caused to cars. In such a situation, it is often tempting to leave the scene. This desire is especially characteristic of the innocent driver. However, such behavior is fraught with rather serious consequences: liability arises in accordance with Article 12.27 of the Administrative Code of Russia. Moreover, both the guilty driver and the innocent one will be involved in it.
The onset of responsibility
According to the Rules of the Road (SDA), an accident is understood as an event associated with the movement of vehicles, as a result of which people were injured or killed, vehicles (HV), cargo, structures were damaged. In this case, the amount of material damage caused does not matter. The duty of drivers who have been involved in an accident is to wait for traffic police officers, and, if necessary, call an ambulance. Leaving the scene of the incident is punishable by deprivation of a driver's license for 1 year or arrest for up to 15 days.
The situation often develops in such a way that the driver is forced to leave the scene of the accident. This may be due, for example, to the delivery of victims to the hospital or to the creation of serious obstacles to movement. In this case, it is necessary to find witnesses and, in their presence, fix the position of the vehicle, as well as objects and traces related to the accident. Failure to comply with these requirements entails the imposition of a fine of 1000-1500 rubles.
Exceptions to the rule
The law provides for the possibility of leaving the scene of the incident in strictly defined cases. Without contacting the traffic police inspectors, you can leave if:
- civil liability of both drivers is insured;
- there are no casualties;
- only 2 drivers were involved in the accident;
- the drivers have no disagreements about the circumstances of the accident and damage to the vehicle;
- at least 1 road accident form has been completed (in accordance with the requirements of civil liability insurance).
If several drivers were involved in the accident, then the accident site can also be left, provided that the above conditions are met. However, in this case, you will have to draw up a scheme of the incident that suits all its participants and contact the nearest traffic police post. In other cases, the perpetrators of road accidents are brought to administrative responsibility.
