Step 1

The general procedure for obtaining a copy of the judgment is established by the Criminal Procedure Code of the Russian Federation. Article 312 of the code stipulates that within 5 days from the date of the verdict by the court, copies of it are handed over to the convicted (acquitted), lawyer and prosecutor. At the request of the victim (civil plaintiff or defendant), their representatives, a copy of the judgment may be served on them.

The literal interpretation of this provision means that convicts, their defenders and prosecutors will receive a copy of the judicial act, even if they do not apply for it. But the victims and their representatives will need to apply to the court with a written statement to obtain a copy. But for both of them, one copy of the verdict is always issued free of charge.

Step 2

However, there are times when several copies of the judicial act are needed. It can simply get lost, it can be used up by attaching it to any statement (claim, for example) or cassation, supervisory complaints as evidence. Therefore, you have to go to court again for the issuance of a repeated or several copies of the verdict.

In this case, a copy of the verdict is not automatically sent to anyone; all participants in the process will have to go to court. Current legislation allows you to receive copies more than once, for this you will need to pay a state fee. The amount of the state duty will be reported by an employee of the court's office, since in each case it will depend on the number of pages of the sentence.

Step 3

Only those sentenced to real imprisonment who are unable to pay it can be exempted from paying the state duty. However, these individuals will need to prove that they really do not have the means to pay. Such evidence can be a certificate from the institution where the convicted person is serving his sentence, about the absence of funds on his personal account, and the absence of any relatives who could pay the state duty.
