Some families break up. After some time, divorced men and women may want to remarry with other partners. But for this, according to the current legislation, they need to provide a certificate of dissolution of the previous marriage to the registry office. If the document is lost or remained with the ex-spouse, who for some reason does not want to return it to you, restore this certificate.

Step 1

Any lost document can be restored after spending some time and paying a fee. But first, look carefully, check all the places where you keep the documents, maybe you just shifted this certificate somewhere. Or try to negotiate in an amicable way with your ex-spouse, to convince you that you will restore the document anyway, and such stubbornness puts it in a very negative light.

Step 2

If you failed to find the certificate or agree with the former half, you need to contact the registry office at your place of residence or at the place of marriage registration with a written application for a copy (duplicate) of the certificate. In the application, indicate: the first names, surnames, patronymics of each of the spouses at the time of the dissolution of the marriage, as well as where and when this dissolution was registered. Within the time prescribed by law, the registry office must give you a duplicate of this document.

Step 3

Often such a situation arises: one of the former spouses has died. His relatives or heirs need to obtain a duplicate divorce certificate to resolve issues related to inheritance. What should be done in this case? The list of persons entitled to receive a duplicate certificate of divorce is determined by Federal Law No. 143-FZ "On acts of civil status" dated 15.11.1997.

Step 4

If you are on the list by status, you should contact the registry office with a written statement, to which you must attach copies of documents confirming your relationship with the deceased. If, for some reason, it is difficult for you to do this, you can entrust the receipt of a duplicate certificate to any adult capable citizen (for example, your lawyer), but in this case he must, in addition to the above-mentioned copies of documents, have your notarized power of attorney.
