To apply to the court for the recovery of alimony from a spouse who refused to conclude an amicable agreement on the material maintenance of the child, it is required to draw up a statement of claim. It must take into account all the nuances of a particular situation and fully protect the interests of the child, therefore, special attention should be paid to the preparation of such a statement and take into account all the requirements for its form by the current legislation of the Russian Federation. The document can be drafted in simple writing or printed on a computer.
Instructions
Step 1
In the upper right part of the sheet, write the details of the addressee (name of the court to which the statement of claim is submitted for the proceedings), the plaintiff (surname, name, patronymic and place of residence of the applicant) and the defendant's full name, address).
Here also indicate the amount of the claim presented by the plaintiff for payment. Do not be afraid to overstate the value of your claims, as the court, having taken into account all the circumstances of the case, may assign a different amount to be reimbursed.
In the center of the sheet, write the name of the document "Statement of Claim for the Recovery of Alimony for a Child (Children)".
Step 2
In the main part of the document, indicate the date of the marriage and its duration. If the marriage has not been registered, inform the court of the time of living together in a civil marriage and running a common household. Here you can refer to the testimony of the existence of such a relationship, recorded in the document attached to the application.
Write the last name, first name, patronymic and date of birth of the child (children) born in this marriage.
Tell the court your demands - how much and in whose favor you are asking the court to recover from the defendant.
Please provide evidence and circumstances allowing the above amount to be claimed. This may be the calculation of the disputed amount and conditions that force to insist on exactly this amount of payments.
Specify the timing of payments by period (for example, monthly or quarterly).
Step 3
In the final part, list all attachments (copies of documents, certificates and a receipt for payment of the state fee) that must be presented for consideration of the case in court.
Indicate the date of the statement of claim and sign.
