When a position or work unit is excluded from the staffing table, a staff or number reduction procedure is carried out. If it is impossible to transfer the employee to another position, dismissal occurs at the initiative of the employer. In this case, strict adherence to all formalities is required. The laid-off employee has the right to appeal against the dismissal in court, while proving the legality of the dismissal and compliance with the redundancy procedure is the responsibility of the employer.

Instructions
Step 1
Prepare a cutback order. Indicate what specific positions are being cut, the reasons for the layoff, the date of exclusion from the staffing table, the officials responsible for processing the layoff.
Step 2
Fill in and approve the new staffing table, indicate the date of validity. The form of the staffing table is approved by the Resolution of the State Statistics Committee No. 1 of 05.01.2004. (unified form T-3). New states are put into effect by order of the head.
Step 3
Form the personal files of the workers eligible for layoff. This is necessary in order to decide on the pre-emptive right to remain at work. There must be documents on education, qualifications, work experience, marital status (the presence of young children from a single mother). The decision on the advantage is made by a commission and should be reflected in the protocol.
Step 4
Provide notifications of upcoming layoffs to employees no later than two months before the layoff date.
Step 5
Offer the downsized workers offers for another job or position, the employee gets acquainted with such offers against signature. This must be done three times: at the time of delivery of the notice of layoff, during the two-month notice period, and before the date of layoff.
Step 6
If the employee is a member of a trade union organization, it is required to notify the primary trade union two months before the layoff. Attach the motivated opinion of the trade union to the employee's personal file.
Step 7
Issue a dismissal order to reduce staff, familiarize the employee.
Step 8
Make an entry in the work book, issue the employee's personal card.
