The Labor Code of the Russian Federation gives detailed instructions on how to arrange the transfer of an employee to another position or to another structural unit of the organization. It is also possible to transfer to another organization by agreement between employers. Any translation can be carried out on written warning and with the personal consent of the employee, except in special cases specified in the TC.

Instructions

Step 1

Provide written notice to the employee 2 months before the transfer. An exception may be cases when the transfer is associated with special circumstances, for example, an accident, declaration of martial law, emergency situations, etc. In this case, you have the right to carry out a temporary transfer without warning and without the consent of the employee, up to the elimination of emergency situations.

Step 2

In all other cases, the employee must be familiar with the notification. Draw up an additional agreement to the employment contract, in which you specify in detail all the points related to the transfer.

Step 3

An employee has the right, before starting work in another organization or in a new position, to receive another unused vacation and only after its end to start performing new duties within the organization or in a structural unit of the enterprise. In this case, the transfer is carried out from the day following the end of the vacation.

Step 4

Issue an order form T-5. Indicate that the employee is granted vacation, for how long, after the vacation the transfer was made, the number of the structural unit or the name of the new position, the term of the transfer. If the transfer is carried out on a permanent basis, then in the order indicate that it is indefinite, enter the date of the beginning of the implementation of new duties.

Step 5

Make all changes to your personal T-2 form card and work record book. Make full payment of vacation and current salary on the last working day. If the transfer is carried out within one structural unit, then you can pay the salary on the day it is issued.

Step 6

If the employee does not agree to the transfer, then he has the right to quit. In this case, the dismissal takes place on a general basis. You have the right to independently decide whether to pay compensation for unused vacation days or provide vacation and enter the date of dismissal the next number after the last day of vacation.
