Since most often this issue affects land and residential premises, the conditions for re-registration in these categories should be considered.
Re-registration of land
Transferring land from one category to another is usually required when it comes to a site related to agricultural land or land of water and forest resources. To build on it, you need to change the category to industrial land. Since most often the land is owned by the constituent entity of the Russian Federation, it is necessary to follow the procedure for changing the category and submit all the documents that are discussed in federal and regional legislation.
An application must be submitted to the local government, which must contain the following information: the cadastral number of the land plot, the rationale for the decision to change the category, an indication of the desired category, the right to land. Together with the application, it is important to submit such a package of documents: a cadastral extract about an object, an extract from the Unified State Register of Legal Entities or USRIP, an extract from the Unified State Register of Legal Entities, the conclusion of the heads of architecture, the consent of all rightholders of the land plot and, if necessary, an environmental impact assessment.
If the application is accepted for consideration, the decision will have to wait two or three months. If the decision is positive, you need to make changes to the land registry and the State Register of Property Rights. After the new cadastral passport is in hand, the procedure for changing the category is considered complete. The issued act with a positive decision is valid indefinitely.
Residential translation
Conversion of residential premises to non-residential premises includes a change in its purpose, legal regime and status. The need for such a translation may be due to various reasons. To complete this procedure, you must contact the local government, which is responsible for the appropriate changes to the category. You should come to the municipal authority with the required documents. The list includes: documents that confirm ownership, a technical passport of the BTI and a floor plan, an extract from the house book that no one is registered in this room temporarily or permanently, a certificate from DEZ about the function and status of other residential premises that are located on the same a floor with a convertible apartment. You will also need a technical opinion from an organization that monitors the condition of the house, the conclusion of sanitary-epidemiological and fire supervision. If the procedure is required for a legal entity, it is additionally necessary to submit the constituent documents of the organization. Other documents may also be required, all the details will be said at the place of registration of the procedure, which is divided into several stages.
The first stage is an appeal to the interdepartmental commission for permission to transfer property from one category to another. The second tap is waiting for the decision of the commission. The third and final stage is the receipt of documents on the change in the status of the premises with a positive decision.
