Necessary

  • - the actual appeal itself (its text);
  • - a copy of the contested decision (determination);
  • - documents confirming the payment of the state duty in the prescribed manner and in the amount (a check from Sberbank) or the right to receive benefits for the payment of the state duty (see Articles 333.35 and 333.39 of the Tax Code of the Russian Federation), or an application for a deferral, payment by installments, or reducing the size of the state fee;
  • - a document confirming the direction (a check from the Russian Post about your sending registered letters) or delivery (receipt of delivery) to other persons involved in the case, copies of the appeal and documents that they do not have;
  • - a power of attorney or other document confirming the authority to sign an appeal (for lawyers and other persons representing your interests in court).

Instructions

Step 1

In the appeal, it is mandatory to indicate:

- the name of the court that made the contested decision, the number of the case and the date of the decision in the final form, the subject of the dispute;

- the name of the person filing the complaint and other persons participating in the case;

- the requirements of the person filing the complaint and the grounds on which the person filing the complaint will appeal the decision with reference to laws, other regulatory legal acts, circumstances of the case and evidence in the case;

- a list of documents attached to the complaint.

Step 2

Attach the following documents to the appeal itself (do not forget to indicate them in the list of documents attached to the appeal):

- a copy of the contested decision (determination);

- documents confirming the payment of the state duty in the prescribed manner and in the amount (a check from Sberbank) or the right to receive benefits for the payment of the state duty (see Articles 333.35 and 333.39 of the Tax Code of the Russian Federation), or an application for a deferral, payment by installments, or reducing the size of the state fee;

Step 3

If you are in litigation on your own, go to the court of first instance that ruled your case and file an appeal with the clerk of the judge who heard your case, or send it by registered mail to the court that made the decision.
