An employment contract is an agreement between an employee and an employer, by virtue of which the employee undertakes to perform work in a certain specialty and observe labor discipline, and the employer undertakes to pay him a salary, provide him with a job and proper working conditions. How to properly draw up an employment contract?
Instructions
Step 1
An employment contract is drawn up with those who have reached the age of 16. However, a 14-15 year old teenager who wants to earn extra money in his free time from school can also work under an employment contract - with the written consent of the parents. It is more difficult to sign an employment contract with a teenager: there are many legislative restrictions, such as the impossibility of assigning a teenager a probationary period, working at night, etc.
Step 2
In some cases, a fixed-term employment contract is drawn up with an employee - for the duration of temporary work, internship or replacement of an absent employee. Also, the employee has the right to conclude an employment contract for part-time work, both with the employer who already provides him with the main job, and with any other.
Step 3
The following data must be included in the employment contract:
1. personal data (according to the passport) of the employee and the full name of the employer;
2. information about the documents (passport) of the employee and the employer's TIN;
3. the date and place of the conclusion of the employment contract;
4. place of work;
5. position and functionality;
6. working conditions and more (depending on the company and the specifics of the profession).
Step 4
To draw up an employment contract, an employee will need to present a passport, work book (if any), education document (if any), insurance certificate. In some cases, men subject to conscription are required to present military registration documents - for example, when applying for civil service. If an employee starts work for the first time, then his first employer draws up a work book for him.
Step 5
The employee starts work on the day specified in the employment contract. An employment contract is valid from the moment it is signed by both parties. Each party receives a copy of the contract.
