Before you draw up a contract for a land plot, you need to determine what kind of transaction you are drawing up: accept the plot as a gift, rent or buy it. The most popular form is the sales contract. This is a two-sided document signed by the buyer and seller.

Instructions

Step 1

Please note that you can only sell or buy a piece of land that is registered with Rosreestr, has a cadastral number and a passport. Before or during registration, such a site is assigned a unique address. In the event that the site has not been put on cadastral registration, carry out work on its surveying, during which the coordinates of the nodes of the turning points that make up its boundaries are determined.

Step 2

Land title documents are an annex to the agreement. Such a document is considered a state act on the right of ownership. Documents confirming this right, which were issued before the new registration law was passed in 1997, are also considered valid.

Step 3

Please note that the object of the contract - the land plot - is described in detail and unambiguously in its text. Be sure to indicate the address of the site, its cadastral number, area, category of land on which it is located, as well as its purpose. For the seller and the buyer, it is necessary to indicate not only the surname, first name and patronymic in full, but also all passport data. If the seller or buyer is a legal entity, indicate its full name, TIN, legal address, number of the certificate of state registration in the Unified State Register of Legal Entities, as well as information on legal capacity.

Step 4

The law does not require mandatory certification of the purchase and sale transaction with a notary, therefore the contract can be concluded in a simple form and signed only by the seller and the buyer. But the deal will be considered concluded only after it is registered with Rosreest and the buyer receives a document certifying his ownership of the site - a state act. To be on the safe side, complete the contract in the presence of a notary, who will also check the correctness of its execution.
