It is interesting that such a concept as amnesty may be related not only to the criminal sphere. Amnesty is quite possible for a dacha! It concerns, first of all, the process of registration in private ownership of all plots that the citizens of our country use for the active management of their personal vegetable garden.
Instructions
Step 1
"Amnesty", in fact, is the popular name for the law, which introduces a special, simplified procedure for certifying ownership of certain groups of objects of various property. These include both the actual land plots and houses, and other outbuildings, such as, for example, ordinary baths and gazebos. If in the recent past many summer residents did not manage to complete the legal registration of their summer cottage property due to the banal lack of all the documents necessary for this, today this can be done in a simplified mode. This law came into force in the summer of 2006. From that very time, the owners had a unique opportunity to correct the property certificate using two elementary documents. These today include a paper on the provision of land for use with absolutely any limitation period, and this also includes exclusive rights to ownership throughout life and the unlimited use of property; and an ordinary cadastral layout.
Step 2
It is interesting that the notorious amnesty is valid for not all lands, but only those of them that were received before the beginning of 2001, because it was then that an absolutely new code of our country came into force, regulating all relations concerning the land. In addition, amnesty today is not subject to lands that have a certain status and belong to protected areas, lands with cultural objects built on them, and buildings of national importance, such as nuclear power plants.
Step 3
If the owner of the plot ultimately did not manage to find the necessary document, which speaks of his exclusive rights to use the land, he can present a simple extract of their household book, which is kept in all garden farms. Otherwise, you will have to buy your own property at the current market value. The law does not impose any restrictions on the number or area of all objects obtained in this way. To register a house, it is necessary to obtain a registration certificate from the BTI, as well as the conclusion of the local authorities that the building is located on the territory of the contested allotment.
Step 4
Taking advantage of the dacha amnesty, the happy owner instantly acquires the natural right to independently dispose of the plot entrusted to him, he can easily donate, sell, bequeath, lease or perform other legal actions provided for by law. It must be remembered that the terms of the dacha amnesty are very limited. Today, the official expiry date of such a simplified registration system is the first day of spring 2015.
