Step 1

Complaints, claims and other statements about the violation of certain rights are submitted to the competent judicial authority in the form of a statement of claim. A claim should be drawn up only if all peaceful arguments to resolve the dispute that have arisen have been exhausted. Depending on the nature of the dispute and the relationship between the plaintiff and the defendant, determine the appropriate court, guided by the current legislation of the Russian Federation.

Draw up a statement of claim in accordance with generally accepted standards specified in the relevant procedural code. Do not deviate from the rules, otherwise the court will refuse the proceedings in connection with a violation of the procedure for filing a statement of claim. In the document itself, indicate the name of the judicial authority, the participants in the process with their address data, the subject of the complaint and the plaintiff's requirements. If the subject of the application is the recovery of material damage, indicate exactly the entire required amount that is due from the defendant. It is advisable to attach various materials to the document that can be used by the court as evidence in the case in your favor.

Step 3

Hand over the application-complaint in person to the staff of the court office or send the claim to the address of the court by mail. In order not to be mistaken with the choice of a suitable court, it is better to immediately send a claim to a court located at the place of residence of the defendant, the legal address of the organization or the location of the property related to the dispute. However, if you do not know the whereabouts of the plaintiff, you can file a complaint with the court in your place of residence. Also, this right is granted in some other cases specified in the current legislation.
