If you have invented something new, you will need to obtain a patent for the invention. In this case, you will receive the necessary protection from competitors and the right to require everyone else to respect your rights to the invention. To obtain a patent, you need to submit an application to the registration authority along with a properly executed application, pay the state fee for patenting and wait a while.

Instructions

Step 1

Check out the rules that govern the provisions of domestic patent law. Make sure your invention meets the Inventive Step Requirements. It is considered as such if for a specialist the invention does not clearly follow from the state of the art that it is not a discovery, a scientific theory and a mathematical method; a solution related only to the appearance of products and aimed at satisfying aesthetic needs; rules and methods of games, intellectual or economic activities; computer program and so on. In addition, the invention must meet the requirements of uniqueness. Before that, no one should have invented something like this, or, in any case, no one else should have a patent for this invention.

Step 2

Submit an application to Rospatent in Russian, and also attach an application for an invention containing a description of the invention, claims, drawings and similar documents, a description of the invention, claims, and an abstract. You must briefly explain the essence of the invention, the scope of its application, methods of its replication (that is, the production of objects in which this invention is expressed), and also briefly describe the formula in words or signs.

Step 3

Transfer the amount of the state duty charged for patenting to the account of Rospatent through Sberbank. You can pay it in several stages, but you must submit receipts for the amount to Rospatent. Within two to three months, you will be answered, informing about the grant of a patent or a refusal to obtain it. The refusal can be appealed in court. Usually the amount is about ten thousand rubles for a patent and five thousand rubles for a patent renewal. In addition, you can apply for an international patent, which costs one and a half times more.
