Step 1

The first step is to get a sick leave. It will be issued in a consultation where the pregnant woman is registered for a period of 30 weeks. In the case when, in addition to the main place of work, the future mother works part-time (and is drawn up in accordance with the Labor Code), then an additional sick leave is issued.

A woman who has adopted a newborn child (or children) can also take maternity leave. In this case, a certificate of incapacity for work is issued at the hospital where the baby was born.

If one child is expected to be born, then the duration of the maternity leave will be 70 days before delivery and 70 days after. With multiple pregnancies, the term increases to 84 and 110 days, respectively. In the case when complications arose during childbirth, or the baby appeared by caesarean section, the postpartum leave will be 86 days.

A woman who has adopted one child is entitled to 70 days of maternity leave, which is calculated from the birthday of the baby. If there are two or more adopted babies, then maternity leave is increased to 110 days.

Step 2

Sick leave (in the case of adoption - a birth certificate) must be submitted to the personnel department, and also write a statement addressed to the head of the enterprise. In the second case, a court decision on establishing the child's adoption or a copy of it, a certificate from the spouse's place of work that he was not provided with the specified leave should be attached. The employer is obliged to calculate the allowance within 10 days after the submission of the necessary documents.

Step 3

The maternity allowance is 100% of the average earnings. According to the amendments made to the law at the end of 2010, the amount accrued over the previous 2 years is taken to calculate the average daily earnings. This amount is divided by 730 (the number of working days), and there is a maximum threshold - the average daily earnings cannot be more than 1137 rubles. (since 2010).

If during these two years the mother was on parental leave, then she has the right to change the corresponding years, if the amount of the benefit increases in this way.

In addition, until January 1, 2013, you can also choose the calculation according to the old scheme, when only one year preceding the decree was taken to determine the size of the average daily earnings.
