If there are grounds clearly limited by the family code, the child's father may be deprived of his parental rights. But before writing a statement of claim, it is necessary to collect a package of documents that, by their content, directly indicate the legal validity of the plaintiff's claims against the defendant.
Instructions
Step 1
When collecting individual documents, you should pay attention to the timing of their legal validity. All certificates received from government agencies will be valid for no more than 30 days.
Step 2
Request a certificate from the Housing Administration about the composition of the child's family. In the event of a difference in the place of registration of parents and children, certificates are provided from all relevant departments.
Step 3
Additionally, it is necessary to request a description from the district police officer, which will contain information about the presence or absence of administrative and other legal measures in relation to the plaintiff and his close relatives (spouse and joint children).
Step 4
Attach a testimonial from the place of permanent work, request information about wages for the last half of the year. When considering the materials, the court will take into account the financial situation of both parties.
Step 5
In case of collecting alimony from the child's father, attach a copy of the court decision. The certificates provided by the federal bailiff service about the timeliness of payments or the presence of alimony arrears will not be superfluous.
Step 6
When the defendant is on the wanted list for non-payment of alimony, the court is provided with the relevant information, confirmed by documents.
Step 7
If the child is attending an educational or other fostering institution, contact the director in order to obtain characterization materials. The description should reflect the participation of both parents in the life and upbringing of the child.
Step 8
If there are decisions of law enforcement officers on previously announced facts of the father's evasion from raising his child, duly certified copies of the decisions are submitted to the court.
Step 9
When the child's father is brought administratively liable for the consumption of alcoholic beverages or drugs, hooliganism and other actions that violate public order, copies of the decisions shall be attached to all collected materials.
Step 10
In the absence of orders in hand, during the trial, the judge, lawyer or prosecutor can request them on their own.
Step 11
In addition to these documents, copies of documents establishing the identity and their family relationship (passports, birth certificates, etc.) are subject to mandatory submission to the court.
Step 12
When drawing up a statement of claim, pay attention to the need to comply with all address details. The text of the statement must contain motivated and only reliable facts indicating the negative influence of the father in relation to the minor.
