After divorce, one of the parents is obliged by law to support their minor children. This is done through monthly alimony payments. They are awarded by the court on the claim of the second parent.
Necessary
the birth certificate of the child; -document on divorce; -statement of claim
Instructions
Step 1
To collect alimony, go to court with the requirements for the second parent of the child. Submit a claim in court at your place of residence, or at the place of residence of the defendant. Attach copies of the child's birth certificate and a document confirming the fact of divorce to the statement of claim.
Step 2
Indicate the desired amount of alimony in the claim. In Ukraine, alimony is collected both as a percentage of the debtor's income and in a fixed amount. The minimum amount of alimony is 30 percent of the subsistence minimum established by law for children of the corresponding age. In 2014, the minimum amount of alimony is: for children under 6 years old - 309 hryvnia 60 kopecks; for children from 6 to 18 years old - 385 hryvnia 80 kopecks; for able-bodied children - 365 hryvnia 40 kopecks; for disabled children - 284 hryvnia 70 kopecks. If a lower amount is awarded by the court, then state aid is paid to the child for the difference.
Step 3
If you want to receive alimony for a minor child as part of the debtor's salary and other income, remember that the amount of deductions cannot exceed 70 percent. When collecting alimony in favor of adult children, the amount of deductions cannot be more than 50 percent of the income of the second parent.
Step 4
Receive a writ of execution in court after the decision on the recovery of alimony has entered into force. Send it for enforcement to the department of the state executive service at the place of residence of the debtor. Attach the original of the writ of execution to the application for opening enforcement proceedings. Indicate in the application the bank account of your own or of the child to which the alimony will be transferred. Further, the writ of execution will go to the enterprise where the debtor works. He will be the basis for deducting the required amount of alimony from his salary.
Step 5
If the defendant does not have a permanent place of work, apply to the bailiff to recover alimony by seizing and selling the debtor's property. In a situation where he is hiding his place of work, do the following. Ask the state executive to ask the tax office at the place of residence of the debtor for information about his income. Knowing the identification code, you can find out both the place of his main work and sources of additional income.
