In the Family Code of the Russian Federation, there are two methods of collecting alimony for the maintenance of underage children. The first is a notarized agreement on the payment of alimony, the second is a court order (act).

Step 1

On the part of the parents, the agreement on the payment of alimony is of a more civilized and compromise nature, since in the course of drawing up this agreement, the interests of all parties are taken into account: the budget, financial situation, parents' employment, the needs of children and their expenses. This type of agreement does not create a hostile atmosphere, which allows maintaining a healthy relationship between parents and children. It is important to note that without notary certification, the agreement has no legal force. It is mandatory to indicate the amount, procedure and method of paying alimony.

Step 2

The recovery of alimony through a court order is often forced by the bad faith of the separately living parent or the annoying reasons for divorce. In the absence of an agreement between the parents, alimony for minor children is collected from the separately living parent monthly in the amount of: for 1 child - 1/4, for 2 children - 1/3, for 3 or more children - 50% of wages or other income. Alimony is calculated on a monthly basis from wages, pensions, business income and scholarships. It is important to note that child support is not withheld from payments that are irregular in nature (premium).

Step 3

Very often, a parent who is obliged to pay child support does not have regular earnings and a stable income, or does not fully disclose the amount of his income. In this case, and also if the given parent has no earnings at all, the court has the right to establish the amount of alimony in a fixed sum of money.

Step 4

The court awards alimony from the date of appeal, i.e. from the moment when the corresponding application was submitted.
