The rights to receive an early pension are regulated by the Law "On Labor Pensions in the Russian Federation" No. 173-FZ dated December 17, 2001 (as amended on December 28, 2013). A mother who has raised a disabled child since childhood is entitled to an early retirement pension, subject to certain conditions.
When is the right to early retirement present
To apply for a pension, you must contact the branch of the Pension Fund in your region. According to the law, if a family has raised a disabled child since childhood, one of the parents is given such a right. Here are the conditions for calculating early retirement pension for the mother:
1. Insurance experience over 15 years inclusive. This includes all the time when the woman was officially employed, this should be reflected in the work book.
2. Reaching the age of 50.
3. Confirmation that the child was raised before the age of 8. In confirmation of this, they take a certificate from local government bodies, which indicates that the applicant for a pension took part in raising a child until he reaches the age of eight.
Subject to the above requirements, a woman is entitled to an early retirement pension. You will also need to confirm the child's disability and provide a number of other documents.
What documents will be needed to receive an early retirement pension
When applying for an early pension, you will need the originals of the following documents: application (the form must be provided on the spot), passport, marriage certificate, child's birth certificate, if necessary, documents for adoption (guardianship), a certificate confirming the fact of raising a child under eight years old, documents confirming the child's disability, work book, may request certificates of wages or other documents. It is also advisable to have copies of the above papers with you.
The application should be made ten days before the onset of the right to early retirement pension, or at any time after the onset of this right.
When applying after the onset of the right, early retirement pension will begin to accrue from the moment the application is submitted, it will not be recalculated.
The day of applying for a pension is considered the day when the employees of the Pension Fund reviewed the application and accepted the documents. It is advisable to keep the second copy of the application, with a note of admission. Documents can also be sent by mail, then the date of receipt will be considered the date of sending the valuable letter indicated in the confirmation receipt.
In the absence of any documents or for other significant reasons, an early pension may be refused.
On the amount of early retirement pension
A situation may arise that the assigned pension will be lower than the amount necessary for existence at the current date, then the state is entitled to an additional payment. This additional payment was introduced in order to increase material security to the subsistence level. Only unemployed pensioners are eligible for a social supplement.
