Unfortunately, divorce is quite common. People who shared a bed of love with each other suddenly become strangers. When the family boat crashes and the relationship cannot be saved, the only way out in this situation is to divorce. If the decision to dissolve the marriage is made, it remains to apply to the state authorities in order to formalize everything according to the law.
Instructions
Step 1
Contact the civil registry office (registry office). The procedure for divorce by these authorities is faster and simpler, but it is possible only if both spouses agree to divorce and they have no minor children together. The exception to the rule are situations when the other spouse is recognized by the court as incompetent, missing or convicted of a crime to imprisonment for more than three years.
Step 2
You should write a statement about divorce to the registry office at the place of residence of both spouses or one of them if they live separately. Together with the application, you must provide a marriage certificate, passport and a receipt confirming the payment of the state duty. After a month, a divorce certificate and a passport are issued with a note that the marriage has been dissolved.
Step 3
In more difficult situations, when one of the spouses does not agree to a divorce or avoids appearing at the registry office, as well as if there are minor joint children, a divorce application should be filed with the court. After collecting a full package of documents and after one month, a court hearing should take place, during which it is possible to resolve the issue not only of terminating the marriage union, but also questions about the place of residence of children and the recovery of alimony from the spouse.
Step 4
If both parties agree to dissolve the marriage, the court may not find out the reasons for this decision and immediately take a decision on the case. But divorce does not always work out so quickly. If there are objections from any party, the court case is suspended and a period for reconciliation is set within three months.
Step 5
If, in the end, the court nevertheless decided to dissolve the marriage relationship, then after its entry into legal force, a decision is sent to the registry office, on the basis of which a certificate of divorce will be obtained. It should be noted that the court decision can always be appealed within 10 days after the announcement.
