Step 1
Before starting to draw up a claim, determine the court to which it must be filed. In most cases, this is done at the location of the defendant - a legal entity and the place of residence of an individual. But in some it is possible to file a claim at the place of residence or residence of the plaintiff.
Indicate in the upper right corner of the application the court to which you are applying, the full name or surname, name and patronymic of the plaintiff and his address and the same information about the defendant, if necessary - the co-defendant.
Title the document "Statement of Claim", place the title in the center of the line.
Step 2
Describe the circumstances of the incident: what exactly happened, where and when, who committed the actions you complained of, what exactly was done, what provisions of the current legislation they contradict, what your rights are violated and from what provisions of the legislation these rights arise.
Also provide the evidence on which you rely (documents, audio and video recordings, etc.), if necessary, call witnesses, write exactly who can act in this capacity. Submit a motion to summon them to court and indicate how you can contact (mailing address for subpoena) each of them.
Step 3
State what you are asking the court for, arguing each point with the provisions of the current legislation.
Step 4
Provide a list of all attached documents: written evidence, calculation of the amount of the claim, receipt of payment of state duty, etc.
Print and sign the application, attach the necessary documents to it and take it to court during office hours.
