The court is an organ of the state that administers justice in the interests of the people. The court performs its functional duties by resolving civil and criminal cases, labor and other disputes, administrative offenses in accordance with the law.
The court is, first of all, necessary for the protection of human rights, and only then - for the punishment of the criminal. Any citizen should be able to defend their interests and rights.
When resolving civil cases, the plaintiff submits an application to the court to consider his problem. After that, in accordance with the procedural legislation, a procedure is carried out in the court and a judge is appointed, who must, within 5 working days from the date of registration of the statement of claim, consider the issue of accepting the statement into its proceedings. Then a ruling is made, according to which a civil case is initiated in a court of 1 instance.
Further, the court issues a ruling on the preparation of the case for the proceedings, which indicates the actions of all parties, as well as the timing of these actions in order to ensure the timely holding of the court session.
Trial preparation is mandatory, in which both parties, as well as other persons involved or their representatives, must participate. The objectives of this preparation are to clarify all the circumstances affecting the correct resolution of the proceedings; determining the law according to which the case will be resolved; establishing the legal relationship of the parties, submitting all the evidence, as well as clarifying the circle of persons taking part in the case; reconciliation of the parties.
After all parties prepare the necessary documents, the judge determines the day of the trial, which must be appointed no later than two months from the date of filing the statement of claim.
