The work schedule of drivers of vehicles should be drawn up taking into account the Labor Code of the Russian Federation and the order of the Ministry of Transport of the Russian Federation No. 15 of August 20, 2004. In accordance with the specified normative acts, the total working time per week cannot exceed 40 hours.
Necessary
- - schedule;
- - timesheet.
Instructions
Step 1
The conditions of work, rest and payment for work, indicate in the employment contract when employment. If an irregular working day is practiced at your company, then set the driver's pay according to the summarized working time for the billing period. Consider the settlement period equal to one month.
Step 2
In the employment contract, indicate at what estimated rate you will pay for the work of the driver of the vehicle. You can set an hourly wage for labor or a daily wage rate. At the same time, calculate the amount of wages based on the hours actually worked, multiplied by the hourly rate, even if the payment of the daily wage rate is indicated in the employment contract.
Step 3
Create a work schedule for all drivers. Familiarize employees with it no later than 1 month before starting work on the new schedule. That is, draw up each next schedule for the billing period at the beginning of the previous month.
Step 4
Do not schedule work shifts that exceed the normal number of working hours, which are calculated taking into account the Labor Code and should not exceed 40 hours per week. Based on a 40-hour work week, you can create any schedule, for example, 5 working days for 8 hours or 2 days for 12 hours, after which you must provide at least 42 hours of rest. It is also permissible to make a schedule that will indicate 3 working days of 12 hours, but the next 42 hours should be days off.
Step 5
Practice shows that often the driver is on the flight much longer than the time specified in the work schedule and employees are involved in work on weekends and holidays. Indicate all actual hours of work of the driver in the T-12 or T-13 time sheet. Calculate the salary for the current month, taking into account the data of the timesheet, and not the work schedule.
Step 6
All processing that is not specified in the work schedule can be carried out only with the written consent of the driver himself and be paid at least double the amount, if the employee has not expressed a desire to receive additional days of rest for all the processed hours (Articles 113, 152 and 99 of the Labor Code of the Russian Federation) …
Step 7
If the driver worked at night, regardless of whether the work was on schedule or outside the schedule, then you are obliged to pay all night hours in an increased amount, which is at least 20% (Article 154 of the Labor Code of the Russian Federation). Night hours are considered to be open hours from 22 to 6.
Step 8
If you are sending a driver on a long-distance flight, then in addition to the shift schedule, make a separate schedule for the route. Indicate in it the time of movement, rest and lunch.
Step 9
If you have drawn up a work schedule for 12 hours, then you must send two drivers on the flight (paragraph 9 of the order of the Ministry of Transport).
Step 10
Introduce the schedule to all drivers against receipt.
