Step 1

According to labor law, you can get a work book in your hands after dismissal. The employer does not have the right to withhold a document confirming the length of service, and is also obliged to timely issue the calculation due upon dismissal. Delay is considered illegal, and the employee has the right to file a claim in court, demanding not only the issuance of a work book, but also compensation.

Step 2

The day of issue of the work book and calculation is the last day of work at the enterprise. If this day is considered a weekend or an All-Russian holiday, you will receive your work book and calculation immediately after the end of the weekend on the first working day. It is also not forbidden to give it out on the eve of long holidays.

Step 3

The employer is obliged to send a written notification to the employee who is not at the workplace on the last day of work, as well as if the resigned person did not appear in time to receive a work book and full payment.

Step 4

If a working employee gets a part-time job in another organization and plans to make an entry in the work book about the part-time job, he must submit a certificate from the second employer so that an entry is made at the main place of work. In this case, the work book is not handed out.

Step 5

Situations often arise when a still working employee draws up an early retirement pension. The Pension Fund of the Russian Federation accepts for consideration only originals of work books confirming the length of service of the insured or notarized photocopies.

Step 6

For notarization or for submission to the work book fund, you can issue an employee a document for a while against a receipt. The Labor Code does not oblige the employer to do this, but it does not prohibit it either (letter from Rostrud No. 656-6-0 of March 18, 2008).

Step 7

After a photocopy or presentation of the original work book to the Pension Fund, the employee must immediately return the document to the HR department for further storage in the safe.
