According to Art. 24 of the Law of Ukraine "On Holidays", partial replacement of vacation with monetary compensation is possible. In particular, this is allowed when an employee who has the right to leave is dismissed, he is transferred to another enterprise, at his own request (but only partially), upon death, etc. Persons under 18 are not allowed to replace vacation with monetary compensation.

Step 1

Calculation of compensation for unused vacation is carried out on the basis of the Resolution of the Cabinet of Ministers of Ukraine dated 08.02.1995 No. 100. To determine the amount of vacation pay, first calculate the average salary for the year, taking into account basic and additional salaries, bonuses and remunerations, supplements and surcharges and excluding one-time payments, business trips and daily allowances, etc. If the employee has worked less, take the period from the first day of the month following the time of registration to work, and until the first day of the month in which compensation is paid for lost vacation days.

To calculate the amount of vacation pay, use the formula: - From = D / (Kg - P) x Cat; where D is the total amount of earnings for the last 12 months before the granting of vacation (or actually worked period); P is the number of non-working days and holidays that fall on the billing period (for example, in February 2008 - April 2008, 1 non-working period falls - Easter) and 1 holiday (March 8) - in total we subtract 2 days from the total number of calendar days; - Kg - the number of calendar days in a year corresponding to the billing period; Cat - the number of vacation days. For example, if the employee's income for the period from February From 2008 to April 2008 amounted to UAH 2100, the amount of compensation will be UAH 214.77 (UAH 2100 / (90 - 2) x 9 = 214.77.

Step 3

Please note that compensation for unused vacation is included in the payroll fund, and the amounts of contributions to the Pension Fund and Social Insurance are withheld in the general manner. If the employee wishes to exchange part of the vacation for monetary compensation, payment of compensation is possible only if the employee was on vacation for at least 24 calendar days. That is, with the total duration of the employee's annual leave of 28 calendar days, he can receive compensation for 4 calendar days, and not for the entire vacation.
