Step 1

If you have not taken full-time leave, you are eligible for 28 calendar days compensation. You are entitled to the same compensation if you have worked for 11 to 12 months. Determine the time for which you were not granted leave and for which leave is entitled. That is, from the time worked you need to take away: a) days when you were not at work or you were suspended from work; b) vacation periods at their own expense, if their total number is more than 14 days.

Step 2

Count the years in which you have not used your vacation. When doing this, focus on working years, not calendar years. For example, you started working on June 25, 2010, then the first working year for which you are entitled to leave will end on June 24, 2011. Here is an illustrative example: You have worked 2 full working years and 2 months. We were not on vacation and decided to quit. You are entitled to compensation for 28 + 28 = 56 days. But there are 2 more months worked. If the surplus of days is less than half a month, then they are not taken into account. So, you are entitled to compensation for 56 days + 28 days: 12 months * 2 = 60.66 calendar days. Round up to 61 days.

Step 3

The amount of payment is calculated according to the figures of payments for the last three months of work. You will be able to receive compensation on the last working day, on the day of dismissal.

Step 4

Compensation is not paid in the following cases: you, as an external part-time worker, were transferred to your main job (exactly transferred); if the worked period is less than half a year; if you worked without concluding an employment agreement, contract. It is possible to refuse vacation or compensation at the urgent request of the employer, but remember that an agreement securing the withdrawal of vacation is illegal and will be considered invalid. It can be appealed against in court at any time.
