In accordance with the Decree of the President of the Russian Federation No. 1313, the registration of non-profit organizations (NCO) in the Russian Federation is carried out by the Ministry of Justice of the Russian Federation or its territorial body (Ministry of Justice of Russia). The procedure for registering an NCO is established by the Federal Law “On state. registration of individual entrepreneurs and legal entities "with the features that are provided for by the Federal Law" On Non-Commercial Organizations ".
Instructions
Step 1
You should apply to the Ministry of Justice for registration of an NCO within 3 months after the decision to create an NCO is made. The circle of persons who can act as applicants is determined by Article 9 of the Federal Law “On state. registration of legal entities and individual entrepreneurs”.
Step 2
To register an HCO, you will need to submit the following documents:
- application in the prescribed form;
- 3 copies of constituent documents (originals);
- decision on the creation of an NCO and on the approval of the constituent documents (2 copies);
- information about the founders (2 copies);
- a receipt for payment of the state duty;
- information about the location of the permanent body of the non-profit organization through which communication is carried out.
Step 3
In some cases, it is necessary to submit other documents defined by Article 13.1 of the Federal Law “On Non-Commercial Organizations”. In addition to the documents listed in the law, the Ministry of Justice has no right to demand any documents.
Step 4
The documents can be submitted by the applicant personally, by mail, using electronic means of communication. In any case, the Ministry of Justice is obliged to issue a receipt to the applicant for the submitted documents.
Step 5
If there are no grounds for refusing registration, the Ministry of Justice, within 10 working days (two full weeks) from the day the documents are received from the applicant, makes a decision on the registration of a non-profit organization and sends to the tax authorities the information and documents necessary for the tax authorities made a corresponding entry in the Unified State. register of legal entities. The record is made within 5 working days from the day when documents and information were received from the Ministry of Justice. Within the next working day, the tax authority must inform the Ministry of Justice that the entry in the Unified State Register of Legal Entities has been made. Within three working days after that, the Ministry of Justice issues a certificate of state registration of a non-profit organization to the applicant.
