A real estate donation agreement can be an alternative to a will, which can be challenged by several heirs.

Step 1
Prepare all the documents required to complete the donation agreement. The main document will be the Certificate of state registration of the right to real estate. If you donate a land plot with home ownership, then order cadastral passports for the house and plot in the regional cadastral chamber and in the BTI (Bureau of Technical Inventory). If an apartment is donated, then a cadastral passport of the apartment is needed, which must also be obtained from the BTI. In the regional department of Rosreestr management, order an extract from the Unified State Register of Copyright Holders. All these documents (cadastral passports and an extract from the USRR) are produced by the relevant services within 5 working days. Contact the notary office at the location of the donated object. The notary will help you draw up a legally sound contract. Perhaps he will require a certificate of legal capacity of the donor or the consent of the spouse to conclude a donation agreement. Such consent is required if the property is jointly owned.
Step 2
After the donation agreement is drawn up and certified by a notary, contact the Rosreestr office for its registration. In the case of a donation agreement, the agreement itself and the transfer of rights from one owner to another are subject to registration. Rosreestr specialists will help you draw up the appropriate statements. Within twenty working days from the date of their submission, a legal check of the documents submitted for registration takes place, as well as the registration of the donation agreement and the newly arisen right. After 20 days, the new owner of real estate (donee) must again come to the management of Rosreestr for a Certificate of state registration of rights.
