If you received a writ of execution as a result of court proceedings, you need to go with it to the bailiffs. But those who have never faced a similar situation have a poor idea of how to correctly draw up a statement and contact the bailiffs.

Necessary

  • - performance list;
  • - information about the debtor;
  • - power of attorney.

Instructions

Step 1

The statement to the bailiffs is drawn up on the basis of the federal law "On Enforcement Proceedings" (you can familiarize yourself with it by clicking on the link at the end of the article). In accordance with this law, a number of basic requirements for writing a document can be distinguished. First, you must indicate in the letter the full details of the bank account, to which the payment will subsequently be transferred. If you want to receive a money order by mail, you must indicate the appropriate address.

Step 2

Begin your application to the bailiffs with the full name of the unit you are applying to. Please enter information about yourself and the debtor below: name, surname, patronymic and address. If the debtor is an organization, provide its tax identification number. In order not to have problems with the fact that the bailiffs are not able to contact the debtor, you should write as much information as possible about this person or organization. You have the right to indicate the debtor's phone number, fax, information about his bank accounts, etc.

Step 3

Start the main part of the application with the requirement to accept the writ of execution (put its number). Write down to which case this writ of execution is related, and who is the recoverer under the court verdict, and who is the debtor. Indicate the amount of money that the debtor is obliged to pay. It is better to write the amount into its component parts: how much for compensation for damage, how much for the return of state duty, how much for the costs of a representative person (lawyer), etc.

Step 4

Make a list of the documents that you attach to the application. These documents must be mandatory: the writ of execution itself (indicate how many paper sheets it consists of) and a copy of the representative's power of attorney, if he draws up an application himself. Date and sign.

Step 5

Take the application to your local bailiff's office and await notification. Make a copy of the document in advance so that you can get a stamp on it confirming the fact of the application. You will be assigned a bailiff within 2-3 days.
