The so-called collection agencies collect debts on loans. In any case, this is how they position their type of activity. In most cases, employees of such services behave aggressively, which is absolutely not permissible and such actions must be suppressed.
Collection services appeared not so long ago and their services are used, as a rule, by private credit organizations that issue loans not entirely legally, that is, without observing all the rules of the law. Such lenders cannot get debt from their borrowers through the court or simply do not want to waste time on litigation and turn to collection agencies for help.
Collection services collect debt on loans from both individuals and legal entities. But their actions are not reflected in any way in the legislation of Russia, that is, in fact, they have no right either to their existence or to carry out their actions. Such firms have absolutely nothing to do with the financial services sector and are registered, as a rule, as private enterprises or LLCs that provide consulting services. In simple terms, they do not at all what is indicated in their statutory documents and their actions are punishable and punishable by law, you just need to contact the police for help.
How collection service employees work
The actions of employees of such a service, as a rule, do not differ in intelligence. At the first stage of the work of the collectors, calls begin to come to the debtor's phone, during the conversation he can be insulted, he and his family can be threatened with reprisals, they promise to deprive this or that property in case of non-payment of the debt.
At the second stage, that is, if the phone calls do not work and the debtor still has not repaid the loan, the collection service employees come to his house. The "delegation", as a rule, consists of strong men who behave like a boor, enter a house or apartment, threaten the owners and can even take away something from household appliances or things, beat the debtor.
How to protect yourself from collection agency employees
To protect yourself from the arbitrariness of the collection service employees, first of all, you need to understand that such a service does not exist at all, that the actions of its representatives are illegal, and they are not only not necessary to be afraid of, but categorically impossible.
Only a bailiff has the right to collect debts from debtors, and then only after a decision has been made on a trial between the bank and the debtor. And even bailiffs do not have the right to threaten and talk rudely with the defendant, and even more so the employees of the collection agency.
If you receive threats in the form of phone calls, then you should record the conversation with the collectors on a dictaphone, having previously notified your opponent about this. With the recording of a telephone conversation, you must contact the police and leave a statement that unknown persons are threatening over the phone.
When strangers knock or call on the door and introduce themselves as employees of the collection service, under no circumstances should you open the door for them. It is necessary, again, to seek help from the police. But not to record the conversation, but to call the police squad, since in this case there is already a direct threat to life and property. It is important to remember that only those people who are happy to see its owner can enter the house, no matter what kind of service they represent.
