The composition of the package of documents for registration of an apartment for a grandson will depend on the form of alienation of real estate. Therefore, first of all, it is necessary to decide: in what way the registration will be carried out - by donation, purchase and sale, allocation of a share or rent. These are, if I may say so, variants of alienation “here and now”. That is, the ownership of the apartment is transferred immediately, without any delay.

If we are talking about a will, the apartment belonging to the grandfather or grandmother will be transferred to the grandson on the basis of the entry into inheritance rights only after the death of the testators. The package of documents for each of these cases is slightly different, therefore, first, consider a list that is common to all of the indicated methods.

Basic documents

So, regardless of what form of alienation the parties to the transaction have opted for, the required documents should include, firstly, the foundation documents confirming the ownership of the transferring party (in our case, the grandmothers and / or grandfathers):

- contract of sale;

- donation agreement;

- privatization agreement;

- barter agreement;

- certificate of the right to inheritance:

- agreement of equity participation, share accumulation or assignment of the right of claim (for apartments purchased at the construction stage);

- court decision (if the apartment was transferred to the current owners on the basis of a court decision).

Please note that the owners must have one of the above documents in their hands, since all possible options are listed here.

Secondly, these documents of title must be registered either in the BTI (in the case of purchasing an apartment before January 31, 1998), or in the regional UFRS (Rosreestr). In doing so, you need to keep in mind the following:

- registration in the BTI is confirmed by the presence of a seal on one of the above documents;

- registration in Rosreestr is confirmed by a certificate of state registration of property rights.

In addition, the parties are required to present passports that prove the identity of the participants in the transaction.

Purchase and sale and donation

When registering an apartment through a sale and purchase transaction or through a donation, additional documents may be required to the main list of documents:

- the consent of the spouse or spouse in case of acquiring an apartment during the period of legal marriage;

- permission of the guardianship authority, if the co-owner of the apartment is a minor or incompetent citizen;

- a certificate from the passport office about the presence of registered / discharged tenants.

Annuity agreement

Registration through the conclusion of an annuity agreement will require the presence of title and, possibly, the following documents:

- the consent of a spouse (when transferring rights to an apartment acquired during a registered marriage);

- permission of the guardianship authority (in the case of a minor co-owner);

- certificate from the passport office;

- BTI certificate containing the appraised value of the apartment;

- cadastral passport of the apartment.

Allocation of shares and will

The composition of the package of documents for the allocation of a share in an apartment is similar to the documentary package for the purchase and sale transaction, plus the possible requirement to provide a cadastral passport for the apartment.

When drawing up a will, you will need to present documents of title to the apartment and a passport confirming the identity of the testator.
