You can return an item without a receipt. However, it is not only the return period that matters, but also what exactly the person wants to return, because, according to the law, not all goods will be returned or exchanged.
Even with a check, you cannot return:
- cosmetics, perfumes, underwear, personal hygiene products;
- cutlery and kitchen utensils;
- jewelry, especially with precious stones;
- medicines, if they are of proper quality;
- some types of print media.
If the product is not included in this list, then with or without a receipt, the buyer can issue a return within 14 days, excluding the day of purchase.
Return of goods without a receipt
According to the consumer protection law, the store has no right to refuse to accept the goods back if:
- the appearance of the product has not changed - it has no flaws, damages, etc.;
- the expiration date for the product has not expired;
- the tightness of the package is not damaged.
Without a receipt, you can not only return, but also exchange the product for another. If the store requires confirmation of the purchase and sale transaction, and the buyer does not have any documents at all, he can give evidence or any facts that confirm that the transaction took place.
In addition, when returning without a check, an application to the administration of the outlet may be required. It must contain: the name of the store, the full name of the seller and contact information, the reasons for the return and, in general, writing the application, the date of purchase, the name of the product, the buyer's requirements for the seller and the time during which the administration needs to consider the application. Date and signature are required.
Returning goods to the market without a receipt
First you need to talk to the seller, and only if he flatly refuses to take the goods back, write a complaint to Rospotrebnadzor. A legally sound complaint of this kind contains:
- the name of the institution where the application will go;
- the address of the market where the person bought the item;
- a detailed description of the problem and the buyer's requirement;
- date, full name and signature of the buyer.
And if you still have a receipt, then you can even return the goods without packaging and without a tag. When the packaging is damaged or is missing at all, the goods can be returned only on condition of inadequate quality. The situation is the same with the tag. In both cases, the store will take the goods for examination in order for it to confirm whether the goods are of high quality or not. And if not, the money will be returned to the buyer.
Products with a tag and complete packaging can be returned without a receipt in any case, if 14 days have not passed yet. If the deadline has expired, you still want to return the goods, but the seller refuses to take it back, the buyer has the right to go to court.
