Actions of representatives of the authorities are not always lawful. Very often this can be seen when arresting traffic offenders who, in fact, did not violate anything. Therefore, even if your rights have been revoked, you always have the opportunity to prove your innocence in court. The main thing is to approach this issue seriously and calmly.

Instructions

Step 1

At the moment when the protocol is completed and signed, the representatives of the authorities give you the documents, check their availability. You must return the documents for the car, write out temporary license and give a copy of the protocol. The protocol must be signed in any case, since refusal to sign is tantamount to an admission of one's guilt.

Step 2

If you were not alone in the car, and the inspector does not enter your fellow traveler as a witness in the protocol, do it yourself in the column "Explanations of the person …"

Step 3

If you are stopped outside the city, then write in the protocol that you are asking to consider the case at the place of residence.

Step 4

Rewrite the names of the witnesses, their contact details and car numbers. It is also advisable to record all the dialogues on a dictaphone at the moment of arrest and photograph the place of the traffic violation.

Step 5

Write a complaint about the official's misconduct within three days after the revocation of your rights. This will be a strong argument in court and the basis for further action. The document must be reviewed no later than 30 days later. Make a complaint in two copies, give one to the battalion in which the employee whose actions were illegal is listed, and on the second you must be given the incoming number and the date of receipt of the document.

Step 6

Prepare for trial. Write an explanation of the case. Explanations of your fellow travelers as witnesses, if any, should also be written. Prepare photos of the site of the violation and draw up a photo report. The act must contain a description of each photograph and the signatures of witnesses in whose presence the photograph was taken.

Step 7

Submit all your evidence and arguments to the court. Ask to call all the witnesses listed in your case files. At the meeting, behave calmly, express your thoughts constructively and exclusively on the case, without personal accusations.
