It is possible to write someone out of the dwelling only in a judicial proceeding. Cases of this category are quite complicated and it will be rather difficult to solve them without the participation of a lawyer.
Instructions
Step 1
File a complaint with the municipality if the apartment from which you want to discharge the alcoholic is not privatized. Your complaint must include a request that the bully be issued an official warning.
Step 2
Prepare all sorts of evidence that the person you are trying to dismiss is not fulfilling their direct employer responsibilities. You can provide receipts for the rent that you paid in full, because if you refused to pay part of it, you could be evicted. If the alcoholic does not live with you in the same apartment, then you need the neighbors, for example, to confirm this with their testimony.
Step 3
Collect all the answers that you received from the internal affairs bodies if you filed complaints about administrative violations committed by the offender. In other words, if this person really lives with you, but his behavior makes life together unbearable and you have called the police more than once to somehow pacify him, then you will need to provide documentary evidence of this. Later, when the case has already reached the court, the testimony of witnesses, who will additionally confirm the documents and your complaints, may be useful to you.
Step 4
Contact a lawyer for qualified help. It is to him that you will first need to provide all the documentation that you have collected in support of your complaints. Of course, you can go directly to court right away. But nevertheless, it is better to do this together with a lawyer, since this is a rather difficult matter. Alcoholism can cause a person to be discharged from their home, but it will be much easier for you to achieve this goal if you have a lawyer with you. Fill in a lawsuit to evict a person who suffers from alcoholism from your shared home, and then bring him (the lawsuit) to court.
