Step 1

You can terminate an employment contract at any time by mutual agreement of the parties, even if it is concluded for a specific period, that is, it is urgent. To do this, you, as the head of the organization, must draw up an order (order) to terminate the employment relationship.

Step 2

If the employee voluntarily decided to terminate the contract, receive a written application from him in your name. It must be written 14 days before dismissal. But in the case of a fixed-term contract concluded for a period of less than 2 months, this notification to the employer must be received 3 days before the termination of the contract.

Step 3

After receiving the application, fill out an order in which indicate the data of the employee to be dismissed (full name), position, date of dismissal and the basis (for example, a statement). Sign the date on which the administrative document was drawn up. After that, give the order for signature to the employee himself. If the dismissed employee wishes to receive a copy of the order, provide it, while at the same time certify in writing that the copy is correct.

Step 4

Make a note in the employee's file stating that the employment relationship has ended. After that, fasten the document, stitch it and move it to the archive. In the employee's work book, make a note about the termination of the employment contract, referring to the corresponding article of the Labor Code of the Russian Federation.

Step 5

If the contract is urgent, three days before its expiration, you, as the employer, must notify the employee in writing about the termination of the employment relationship. That is, his application for termination of the fixed-term contract is not required.

Step 6

In the event that the contract is concluded for the duration of any work and this is stipulated in a legal document, then the date of termination of the contract is the date of delivery of the object.
