What is left to do for a woman left with a child in her arms? Only write a statement of claim to the court.
Instructions
Step 1
Prepare all documents. First of all, you will need proof of your joint residence and housekeeping, namely: - certificates and certificates from government agencies (including the registry office and housing department);
- payment documents;
- certified certificates of neighbors (yours and the defendant's);
- extracts from the autobiography of your child's father;
- personal correspondence and audio-photo-video materials.
Step 2
Collect and evidence that the defendant actually admitted paternity (including during your pregnancy). It can also be personal correspondence, certificates from the antenatal clinic, maternity hospital, registry office.
Step 3
In addition to all the listed documents, you will need a passport and a child's birth certificate (original and certified copy).
Step 4
Go to court at your place of residence. Take the application form. In the upper right corner, indicate the name of the court to which you applied, the full name and address of the plaintiff (yours) and the full name and address of the defendant (if you know it at the moment).
Step 5
Write in what period of time you were de facto in a marriage relationship with the defendant. Write in what period (before or after the end of the relationship) the child was born. Point out that although the respondent is the father of the child, he refuses to legally establish this fact.
Step 6
Indicate what kind of evidence confirms his paternity (list of documents), facts of cohabitation (list of documents), provide facts of confirmation of paternity by the defendant.
Step 7
Ask the court: - to establish the paternity of the defendant (indicating once again his full name, address, as well as the date and place of birth, place of work);
- collect alimony from him (the column is filled in at the request of the plaintiff).
Step 8
Sign the application and, along with all documents, submit it to the court registry.
