If parents abuse their rights to the detriment of the child or do not fulfill their obligations to support and educate children, subject them to violence, or are sick with alcoholism, drug addiction, then according to the Family Code, parents can be deprived of their rights to their children. This exceptional measure is aimed at protecting children and is carried out only through the courts. The prosecutor, one of the parents, guardianship and guardianship authorities can apply to the court with an application for deprivation of parental rights. The case is considered by the court, and any court decision is made on the basis of evidence. Therefore, it is necessary to attach to the statement of claim documents for deprivation of parental rights, confirming the violation by the parents of the child's rights or failure to fulfill parental responsibilities in relation to the child.

Start preparing a statement of claim by collecting documents. First, make a copy of the child's birth certificate - this is the first document required.

If the parent was obliged to pay child support by a court decision or a notarized agreement, but does not make payments, then make a copy of these documents and get a certificate of support arrears from the bailiff.
Step 4
In the case of a child living with a parent who is deprived of his rights, contact the guardianship and guardianship authority with an application for an inspection and drawing up an act of inspection of living conditions with the issuance of an opinion on the compliance of living conditions with the requirements for living of a minor child.

If the parent is sick with drug addiction or alcoholism, attach to the statement of claim a petition to the court to send a request to a drug treatment clinic for a certificate confirming being registered with a drug addiction doctor.

A document confirming that the parent is not involved in raising the child may be a certificate issued for the child from the school or kindergarten, which indicates which of the parents comes to parental meetings, and also brings and picks up the child.

Then write a statement of claim, indicating in it what parental rights and obligations are not respected, what rights and interests of the child are violated, then indicate that you are asking to deprive the parent of his rights and oblige him to pay alimony.
